Terms of Service.

The following terms of use (“Terms of Use”) govern your use of the Care in Choosing LLC’s website (the “Site”). This is not an agreement or contract, or implied agreement or contract that you must use Care in Choosing, LLC for referral and placement.

 

To use this Site and the services, you must be of legal age to enter into a binding contract and not be prohibited from using the Site or the services by the laws of the jurisdiction from which you access the Site or the services.

 

Care in Choosing LLC exists to offer families care options for independent living, assisted living and memory care communities. Care in Choosing uses care assessment and the answers provided to us to us help to determine appropriate level of care and options for senior care housing. Care in Choosing operates under the assumption that answers provided during an assessment are truthful and forthcoming to the best ability you are able.  If there are Power of Attorney’s involved, we are notified as to who those parties are for an individual.

We will determine the best care options based on AZ Department of Health Service annual inspection surveys and our own objective interview of one or several of the following staff, owner, administrator, executive director, admissions personnel or caregivers.  We may also take into consideration our past client’s feedback about a particular community.

 

Even though our services are paid by our facilities that Care in Choosing chooses to partner with, we consider that we are your advocate to act in your or your loved one’s behalf to present the best options for care possible based solely on the information that you give us or we receive from or any medical/non-medical care providers with your permission.

 

Care in Choosing, LLC is not involved in the actual payment transaction between our client and the care providers and does not promote or recommend any one particular provider.

 

Care in Choosing, LLC cannot guarantee a placement with occur even going through this process. Care in Choosing, LLC does not guarantee that the placement will satisfy the needs of either user or care provider/facility. Care in Choosing, LLC will do everything in our power to assist in discussion or mediation between you and the provider to the best of our ability and resources. If requested, Care in Choosing, LLC will facilitate communication and assist in making a proper forum where you, the provider and Care in Choosing, LLC can meet to discuss any dissatisfaction that you may have with the provider.

 

All fees associated with the Care in Choosing, LLC referral and placement services are paid by providers.

 

Any information or content on this website or any social media forum does not provide medical advice.

 

We accept no responsibility for any claims to accuracy or validity of the information relating to Care in Choosing’s website are as to content, materials, trademarks and other intellectual property contained in the Site, are the exclusive property of Care in Choosing, LLC.

 

If you choose to be a client or customer of Care in Choosing, LLC, you authorize Care in Choosing, LLC to provide the information that you submit in a request for information to a limited number of providers for the purpose of matching your request with the services of providers. Such authorization shall continue in effect unless Care in Choosing, LLC receives written or verbal notification from you to cease providing such information to providers.  At that time, we will discontinue representing you to care providers.. You may send that request to info@careinchoosing.com. It is your choice in which referral or placement company tyou would like to represent you.  If you have already been referred to a community by another referral and placement service, we have the right to decline to personally show you that community in person.

 

The use of and dealings with the owners or operators of any external websites provided by us are at your own risk. You cannot make any claim against Care in Choosing, LLC out of your use of external websites.

 

Your contact information will be retained by Care in Choosing, LLC, however, except as set forth herein and in our privacy policy, we will not sell your information to any third parties. Care in Choosing, LLC is not a covered entity under the Health Insurance Portability and Accountability Act, often referred to as HIPAA. You may receive communications by email to confirm your request, or for us to communicate any additional information to you that may be required by State or Federal Law.

 

You expressly agree that all content and services provided on or through this site are provided “as is” and “as available” for your use. Care in Choosing, LLC expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Your use of this site and the service is solely at your own risk.

 

Care in Choosing, LLC will bear no liability for any products, services, information or other materials displayed, purchased, obtained in connection with the service or the site. Care in Choosing, LLC does not endorse, warrant or guarantee the products or services of any of its care providers or partners.

 

Care in Choosing, LLC and its owner, directors, officers, partners, employees, representatives, contractors, affiliates, successors shall not be liable for any indirect, incidental, special or consequential damages resulting from the use or the inability to use the service or the site. The limitations of liability and disclaimers in this agreement shall apply regardless of the form of action, whether in contract, warranty, strict liability, negligence or another tort.

 

You agree to indemnify and hold each of Care in Choosing, LLC, its owners, officers, directors, employees, partners, representatives, contractors, successors and assigns harmless from any claim or demand, including attorneys’ fees, arising out of your use of the site or services or your violation of our Terms of Use, or the infringement by you of any intellectual property or other right of any person or entity.

If there is a breach in any provisions of the Terms of Use, you may no longer use the Care in Choosing, LLC Service or the Site. You may cease using the Care in Choosing, LLC Service or the Site at any time.

 

Care in Choosing, LLC may, in its sole discretion, change, suspend, or terminate, temporarily or permanently, the Service or the Site or any part of it at any time, for any reason, without liability of notice to you.

 

If Care in Choosing, LLC terminates the Terms of Use for any reason, the Terms of Use will continue to apply and bind you with respect to your prior use of the Service or the Site
